Dickson Productions TERMS AND CONDITIONS

General – Thank you for choosing Dickson Productions, Inc. Upon full payment of the tour price by the tour participant ("you" or "your") named in the Reservation Application agreement ("application") Dickson Productions Incorporated, 6425 S. IH 35 Suite 105, PMB #293 in Austin, TX 78744-4230, ("We, Us, Our or DP") agrees to provide the services specified in the accompanying advertising subject to the terms, conditions and limitations contained in this agreement and Carnival Cruise Lines terms, conditions, and limitations (see www.carnival.com or contact DP for a copy). This agreement shall be effective when the Application is properly completed, signed and payments therein specified are received and accepted by us. If we do not receive your completed Application, We cannot include You on the tour. Neither You, representatives, nor Your travel agent may modify, add, or delete any terms of this agreement.

Minors and Student (age 18 through 20 years) Groups- Per Carnival Cruise Line terms and conditions. If under 21 years, a minor must have a parent, relative, or guardian traveling with the minor in the same stateroom. Please note the drinking age on all Carnival ships is 21.


Carnival’s Sail & Sign Open Bar and Wine program (AS PROVIDED BY CARNIVAL CRUISE LINES)

Open bar and Wine Program is made available and provided for the package trip to enhance the group’s cruise program, as well as budget and plan their overall cruise experience.  Please read the below important details and regulations regarding this special inclusion:

Open Bar and Wine will include all beers, malt beverages, liquors, sodas, and non-alcoholic beverages priced at or below $7.50.

A selection of fine wines by the glass consisting of sparkling wine, white zinfandel, white wine, and red wine will be offered at all bar locations.

All bottled wines served in the Main Dining Room with dinner will be selected at the discretion of Carnival Cruise Lines with both red and white wines being offered each night

Open Bar and Wine Program is exclusive of drinks over the price of $7.50; any wine by the glass other than those offered in the program; souvenir glass drinks; bottle sale of liquor, wine, and/or champagne; large bottles of natural spring water; in-cabin mini-bars and/or any other in-cabin beverage program; drinks ordered through room service; cigars; cookbooks and/or bar books; coffee and/or food items from the “Coffee Shop” Café; and any retail purchases or service charges.

Two Sail & Sign Cards will be issued to each guest. A standard Sail and Sign Card will be issued to all group members and will be processed as per our established procedure.  The second specialty “Sail & Sign Open Bar Card” will include the guest’s name, will indicate “For Beverages Only” , and will be in each of the group guest cabins upon arrival.

The following terms and conditions will apply to the Open Bar and Wine Program.   

  1. Carnival reserves the right to verify a guest age at any time and further reserves the right to confiscate a specialty “Sail & Sign Open Bar card” in the possession of a minor guest. In such cases, the specific account will be closed and the program purchaser, group, guest and/or agency will not be afforded a refund.
  2. The specialty “Sail & Sign Open Bar Card” cannot be used for purchases of drinks over the price of $7.50; any wine by the glass other than those offered in the program; souvenir glass drinks; bottle sale liquor, wine, and/or any retail purchases or service charges. Large bottled natural spring water, in cabin mini-bars and/or any other in-cabin beverage program and drinks ordered through room service are also excluded from the Open Bar and Wine program. In the event a program member wants to purchase any specialized item that is not included or covered under the Open Bar and Wine Program, he/she will need to use their standard Sail & Sign Card (their personal account).
  3. This specialty “Sail & Sign Open Bar Card” will be used to purchase drinks only within limitations of the program, and will not be accepted in the Gift Shop, Beauty Salon and Spa, Photo gallery, Formalities Shop, “Coffee Shop” café, Supper Club for Reservations, for Camp Carnival Babysitting Fees, Casino, Shore excursions, or any other retail purchases or service charges. Program members will need to use their standard Sail & Sign card (their personal account) for these programs.  
  4. When requested by a guest, small individual size bottles of natural spring water will be served as part of the Open Bar and Wine Program. When ordering bottled natural spring water one small individual size bottle will be provided at a time, the bottle will be opened by the bar server, and the bottle cap will be given to guest upon request.
  5. Bottled wine at dinner is restricted to the selections chosen by Carnival for that evening in the Main Dining Room. Groups will be seated in the same area of the dining room to facilitate bottled wine service. While in the Main Dining Room, guests can also order any drink from the bar that is covered by the Open Bar and Wine Program. If while in the Main Dining Room a guest would like to order a bar drink not covered by the program or a bottle of wine/champagne other than the selections being served as part of the program for that evening, he/she will need to use their standard Sail & Sign card (their personal account) for the purchase.
  6. It is the guests’ responsibility to show the “Sail & Sign Open Bar Card: for each beverage purchase covered in the Open Bar and Wine program. If a guest should accidentally charge a beverage covered on the program on their standard personal Sail & Sign Card, Carnival will not be liable or able to transfer the beverage charge to their specialty “Sign & Sail Open Bar Card”.
  7. The specialty “Sail & Sign Open Bar Card” can be used to purchase drinks for the cardholder and for members of the same group only, providing everyone is present and shows their specialty “Sign & Sail Open Bar Card” to the server. The specialty “Sail & Sign Open Bar Card” cannot be used to purchase drinks for other guests not traveling within the same group. In the event a guest wishes to purchase drinks for a non-program member, he/she will need to use their standard Sail & Sign Card (their personal account) for such purchases.
  8. Carnival Cruise Lines reserves the right to refuse to serve alcoholic beverages and/or confiscate the specialty “Sail & Sign Open Bar Card” of any guest who is visibly intoxicated. Such a decision is completely within Carnival’s discretion and Carnival shall not be liable to the guest, the group, the program purchaser, or the agency for its decision. In such cases, the specific account will be closed and the program purchaser, group, guest and/or agency will not be afforded a refund.
  9. Carnival Cruise Lines reserves the right to confiscate the specialty :Sail & Sign Open Bar Card” from any Open Bar and Wine Program member who uses their card in any manner other than specifically approved. In such cases, the specific account will be closed and the program purchaser, group, guest, and/or agency will not be afforded a refund.
  10. GALVESTON SAILINGS ONLY-Texas Liquor Law states that all liquor consumed while the ship is in port, and within 9 miles of Texas must be purchased directly from the State of Texas. Due to this Law there is a condensed menu of drinks being served while our vessels are in this territory. The areas that will be open upon embarkation serving the condensed menu will be the Casino Bar, Lido Pool Bar, & Lido Grill Bars.
  11. All price quotes are in US Dollars and are subject to change without prior notice.
  12. Carnival reserves the right to modify or cancel the Open Bar with Wine Program at any time.
  13. Acceptance of the Open Bar and Wine Program by the agent, program purchaser, group, and guests is based on the above terms and conditions, which are non-negotiable.
  14. This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to choice of law principles. Exclusive jurisdiction for litigation of any dispute, controversy or claim arising out of or in connection with this Agreement or the breach thereof shall be brought only in the Federal or State court with competent jurisdiction located in Miami-Dade County, FL.
  15. This Agreement contains the entire agreement between the parties with regard to the Open Bar with Wine Program. The provisions of this Agreement supersede and replace any and all prior agreements or understandings between the parties, whether written or oral.   

Please Note: Open Bar and Wine Program is not available or applicable for the “land portion” (Galveston Island Hotel portion or on Cozumel Island) of TheBigMusicCruise. The program is offered only while onboard the ship under the terms and conditions provided  by Carnival. Enjoy and please drink responsibly.


Payments - All checks are made only to Dickson Productions, Inc. or your certified travel agent. Final payments must be made by April 30th, 2008. Any person that makes a reservation after April 10th, 2008 must pay in full. We cannot be responsible for reservations when final payments are not received on time, in which, the cancellation policy will be in effect. Any reservation made after April 10th must be paid in full by cashier’s check, money order, or credit card. DP does not take responsibility for lost or delay in mailing. Do not mail cash. A $30.00 late sign-up fee will be added to the package price when DP receives reservations deposit after Feb. 22nd, 2008. All registrants must be paid in full no later than 5pm CST, April 30th, 2008. Any final payment not received by 5pm CST, April 30th, 2008 will result in your cancellation from the trip with no refund of deposit or payments made. All reservations are made on a first come, first serve basis.

Cancellation Policy –
Important! Cancellation policies for Dickson Productions and Carnival Cruise Lines are different and entirely separate. All Dickson Productions group cruise registrants must abide by Dickson Productions cancellation policy below.

Before Feb. 22nd, 2008    100.00 cancellation fee

After Feb. 22nd, 2008    200.00 cancellation fee

After April 30, 2008    No Refund

All cancellations must be made in writing including date and signature of person making the cancellation. Cancellation policy will be in effect if payments are not received on time or written cancellation notice is not received by DP. DP is not responsible for lost payments or delay in mailing. Cancellation by phone must be confirmed in writing by fax or mail within 3 days from the person that cancels.

Guest Changes- Name changes are allowed at Carnival Cruise Lines’ and Dickson Productions’ discretion. There will be a $100.00 net service fee for any and every change involving names.

Return Checks - DP shall collect a $30.00 charge for any returned checks. The $30.00 returned check fee plus the original amount of the check must be paid to DP within 72 hours of your verbal or written notification by DP or your reservation will be canceled. The amount due must be paid by money order, cashier’s check, or certified check.

Collection Cost -Participant agrees to pay reasonable attorneys fees and other expenses incurred by DP in the collection of unpaid damages, insufficient or stopped checks, credit card reversal or misrepresentation or other losses under this agreement if such collection is deemed necessary by DP.

Less Than Maximum Occupancy - If your accommodation is not filled to maximum occupancy due to cancellations or inability to fill vacant space(s) by trip participants, the remainder of the participants in the unit will be charged according to less than maximum prices.

Insurance - We recommend the purchase of comprehensive travel insurance plans for cancellation protection, personal liability, luggage insurance, accidental death/dismemberment, and medical coverage.

Trip Agenda and Procedures - DP and sponsoring representative(s) cannot accept responsibility for your failure to verify trip dates, time and location of departure, all activities and events. An information sheet will be sent to you by mail or posted online at www.thebigmusiccruise.com. DP cannot be responsible for loss or delay in mail or incorrect address on your sign-up form.

While we don't condone or expect the use of inappropriate language, please be aware that some language may not be appropriate for all ages. Parents' or guardians' discretion is advised. There is not a " 7 second delay " on live performances.

Entertainment Package Trips - In the event of cancellation or any portion of the celebrity or entertainment package is not fulfilled, DP will refund only the entertainment portion of the package applicable to the package excluding any sponsorship paid portion. The refund will not exceed $50.00. DP will not refund accommodations, taxes, and transportation portion of celebrity package due to cancellations or unfulfilled portions trip entertainment package by the celebrity. Venues, artists, and schedule are subject to change without notice.

Tour Agreement - DP and the sponsoring representative(s) are acting solely as agents. They are responsible for making the arrangements for all accommodations and services which constitute the trip, except to the extent that accommodations or services cannot be supplied due to reasons beyond control of the agents. The above parties are not in any way liable for personal injury, death, property damage or loss arising out of the act, omission or negligence of any direct air carrier, motor coach company, hotel or any person rendering any services or accommodations in conjunction with the tour. Furthermore, the above parties are not in any way responsible for any injury, damage or loss to reason of theft, accident, or any reason beyond control of those parties. DP and Co-sponsor reserve the right to use similar accommodations and services to the original ones sold if the original property becomes unavailable for any reason. The operator will make no changes or alterations in the itinerary unless it appears to be in the best interest of the participant. DP reserves the right to use pictures and videos of participants for use in promotions of future trips. You are responsible for providing your correct name, as written on your valid U.S. Passport. It is your responsibility to proof your DP provided invoice and respond immediately to DP if any information is incorrect. You assume all responsibility for providing correct documentation/proof of citizenship as the following organizations require: Carnival Cruise Lines, U.S. Customs and Homeland Security.
